2. Scope and acceptance of the Terms

2.1. These General Terms and Conditions (the “Terms”) apply to sales contracts concluded through the Webshop between the Seller and the buyer (the “Buyer”).

2.2. The Buyer accepts the Terms at checkout, before sending the order, by ticking a checkbox.

2.3. A consumer is a natural person acting outside their profession, independent occupation or business activity. The rights of consumers – in particular the right of withdrawal – do not apply to a Buyer purchasing as a business (company). At checkout the Buyer indicates whether they buy as a private person or as a company.

2.4. The Seller may amend the Terms unilaterally. An amendment takes effect on publication and applies only to orders placed after it takes effect.

2.5. The language of the contract is Hungarian. Versions of the Terms in other languages are translations for information; in case of any difference the Hungarian text prevails.

2.6. The Terms and the contract are governed by Hungarian law.

3. The product

3.1. The Webshop sells the printed technical book “Injection Molding Mastery” (Hungarian title: “Fröccsöntés Mesterfokon”), published by the Seller, in Hungarian, English, German, Czech, Portuguese, Italian and Polish editions. The product page shows which editions are available and in stock.

3.2. The Buyer chooses the language of the book when adding it to the cart; the editions in different languages are separate product variants.

3.3. The pictures on the product page are illustrations.

3.4. The book is protected by copyright. Its content may not be copied, distributed, made public or uploaded to a public platform without the written permission of the rights holder.

4. Prices and VAT

4.1. Prices in the Webshop are gross prices in euro (EUR) and include the 5% Hungarian VAT applicable to printed books.

4.2. The checkout shows the total payable – including shipping and VAT – before the order is sent. VAT:

  • Buyer in Hungary (private person or company): 5%;
  • company registered in another EU member state with a valid EU VAT number (checked by the Webshop in the European Union’s VIES system): no VAT, as a VAT-exempt intra-Community supply of goods;
  • private person in another EU member state: 5% Hungarian VAT;
  • private person outside the European Union: 5% Hungarian VAT;
  • company outside the European Union: no VAT (export of goods).

4.3. Shipping is subject to the same VAT rate as the book.

4.4. For deliveries outside the European Union, any customs duty, import tax and the carrier’s customs clearance fee arising in the country of destination are paid by the Buyer.

4.5. Incorrect price. If an obviously incorrect price appears in the Webshop (for example 0 euro, or a price grossly different from the usual price), the Seller is not obliged to sell at the incorrect price. In that case it offers to perform the contract at the correct price; knowing this, the Buyer may withdraw from the purchase, and the Seller refunds any amount already paid without delay.

5. Coupons

5.1. The Seller may issue discount coupons (a percentage or fixed-amount discount, or free shipping).

5.2. Coupons are redeemed at checkout; one coupon may be used per order. The coupon’s conditions set its validity period, minimum order value, number of uses and the editions it applies to.

5.3. Coupons cannot be exchanged for cash, cannot be combined with other discounts, and cannot be applied after the order has been sent.

5.4. In case of withdrawal or refund, the Buyer receives back the amount actually paid; a coupon that was used is not credited again.

6. How to order

6.1. The Buyer chooses the language of the book and the quantity and puts the book in the cart. After choosing the country of delivery, the cart shows the shipping fee and the total.

6.2. At checkout the Buyer gives their email address, telephone number, billing details (for a company, the company name and tax number) and delivery address; may enter a coupon code; and chooses the payment method.

6.3. Correcting input errors: before the order is sent, the summary at checkout shows the products, the shipping fee, the VAT and the total; the Buyer may correct these and the details entered at any time, and the cart can be changed. If the Buyer notices an error after sending the order, they should report it without delay at [email protected].

6.4. The Buyer accepts the Terms and, when paying by card, expressly accepts SimplePay’s data transfer declaration.

6.5. By pressing the “Order with obligation to pay” button the Buyer makes an offer:

  • when paying by card, the Buyer is taken to SimplePay’s secure payment page;
  • when paying by bank transfer, the Buyer is taken to the Webshop’s order page and receives a proforma invoice with the payment details by email.

6.6. Shipping price on request. If there is no fixed shipping price to the country of delivery, the checkout says so and the button reads “Send order request (no payment now)”. Sending an order request creates no obligation to pay and is not an offer. The Seller emails the shipping price, the total and how to pay (a payment link for card payment, a proforma invoice for bank transfer), and reserves the books until the stated payment deadline. The Buyer makes the offer by paying the total. If the Buyer does not pay by the deadline, the order request lapses without consequences; a request that receives no answer closes after 30 days.

7. Conclusion of the contract

7.1. The Seller confirms receipt of the order by email without delay: for card payment immediately after successful payment (this is also the confirmation under clause 7.2), for bank transfer and for order requests when they are sent (in that case the confirmation under clause 7.2 is the email sent after the amount is received). If a card payment fails, is cancelled or times out, the Buyer also receives an email about it, with a link to try paying again.

7.2. The contract is concluded when the confirmation email is sent following successful payment (for bank transfer, following receipt of the amount). The confirmation email includes the invoice.

7.3. If the confirmation of receipt of the order does not arrive within 48 hours of sending the order, the Buyer is released from their offer.

7.4. The contract is concluded electronically and qualifies as a written contract. The Seller records the order; the Buyer can access it through the link in the emails.

7.5. The Seller has not subscribed to any code of conduct.

8. Payment and invoice

8.1. Card payment through the system of SimplePay Zrt. The Buyer enters the card details only on SimplePay’s secure payment page; the Seller neither sees nor stores them. SimplePay’s payment information: https://simplepartner.hu/PaymentService/Fizetesi_tajekoztato.pdf

8.2. Bank transfer against a proforma invoice, for both private and company Buyers. The Buyer receives a proforma invoice by email with the details of the Seller’s euro bank account; the payment reference is the order number. The payment deadline is 8 days; the Seller reserves the books for this period. If the amount does not arrive by the deadline, the order is cancelled and the Buyer is informed by email. Bank charges for the transfer are borne by the Buyer.

8.3. If the card payment fails, no contract is concluded; the Buyer may try to pay again from the order page or from the email about the failed payment until the order closes (about 40 minutes after ordering).

8.4. After payment (for bank transfer, after receipt of the amount) the Seller issues a paper invoice in euro. The printed invoice is sent in the parcel; a PDF copy is also sent by email. The invoice is in Hungarian; for orders placed in another language it is bilingual (Hungarian and the Buyer’s language: English, German, Czech, Polish or Italian; English for orders placed in Portuguese).

9. Delivery

9.1. The Seller ships the book to countries worldwide, except countries and territories subject to restrictive measures of the European Union and places the courier does not deliver to; these cannot be selected at checkout. Currently these are: Russia, Belarus, North Korea, Iran and Syria.

9.2. The shipping fee is per order, regardless of the number of books:

Country of delivery Shipping fee (gross)
Hungary €10
Other member states of the European Union €25
Countries outside the European Union individual price, as in clause 6.6

9.3. The Seller dispatches the parcel within 2 working days of payment (for bank transfer, of receipt of the amount). Expected delivery time from dispatch: Hungary 1–3, European Union 3–7, other countries 5–15 working days. The Seller delivers the product within 30 days of the conclusion of the contract at the latest.

9.4. Delivery is carried out by a courier chosen by the Seller (primarily GLS); the Buyer does not need to choose a delivery method. On dispatch the Buyer receives the parcel tracking number by email.

9.5. Damaged parcel: the Buyer should check the parcel in the courier’s presence. If it is damaged, the Buyer should have a damage report drawn up with the courier or take photographs, and notify the Seller at [email protected].

9.6. If the parcel is returned for a reason attributable to the Buyer (wrong address, failed delivery), the cost of sending it again is borne by the Buyer.

9.7. Detailed rules are set out in the Payment and Delivery Information.

10. Right of withdrawal

A consumer may withdraw from the contract without giving any reason within 14 days of receiving the product. The detailed rules and the model withdrawal form are set out in the Withdrawal Information.

11. Warranty for defects, product warranty, guarantee

11.1. Warranty for defects (kellékszavatosság): in case of defective performance by the Seller, the Buyer may request repair or replacement; if that is not possible, the Buyer may claim a price reduction or withdraw from the contract. For a consumer, a defect discovered within one year of performance is presumed to have existed at the time of performance. A consumer’s warranty claim for defects expires two years after performance.

11.2. Product warranty (termékszavatosság): in case of a defect of the product, a consumer may also claim against the manufacturer; the publisher and manufacturer of the book is the Seller.

11.3. Guarantee (jótállás): no mandatory guarantee is prescribed by law for the book; the Seller does not offer a voluntary guarantee.

11.4. The Seller replaces a defective copy (for example with printing errors or missing pages) free of charge. To request this, the Buyer should write to [email protected] with a photograph.

11.5. The consumer’s rights under the warranty for defects and the product warranty are governed by sections 6:159–6:170 of Act V of 2013 on the Civil Code (Ptk.) and by Government Decree 373/2021 (VI. 30.) on the detailed rules of contracts between consumers and businesses for the sale of goods and the supply of digital content and digital services; their current text is available at https://njt.hu. The information required by Government Decree 45/2014 (II. 26.) on the detailed rules of contracts between consumers and businesses is contained in these Terms and in the Withdrawal Information.

12. Complaints and remedies

12.1. The Buyer may make a complaint by email: [email protected]; by telephone: +36 76 739 125; by post: Cavity Eye Hungary Kft., 6000 Kecskemét, Mindszenti körút 27/A, Hungary.

12.2. The Seller answers a written complaint in substance, in writing, within 30 days of receipt, and gives reasons if it rejects it. The Seller keeps the complaint and the answer for 3 years.

12.3. If the complaint is rejected, the Seller informs the consumer in writing which authority or conciliation board they may turn to.

12.4. Conciliation board. A consumer may turn to the conciliation board (békéltető testület) competent for their place of residence or stay. The list and contact details of the conciliation boards: https://bekeltetes.hu.
